The defendant does not have the burden to present any evidence. However, if the defense presents evidence, the State will have the opportunity to present rebuttal evidence. The judge can allow a witness who was not identified by the State to testify in rebuttal as long as the undisclosed witness is a true rebuttal witness and not an important part of the State's main case.
