Due Process hearing
If parents and the school cannot agree on things like how a child is identified for special education, how they are evaluated, where they should learn, or what services they should receive, either one can ask for a due process hearing. A due process hearing is a formal hearing with a neutral person who listens to both sides and helps makes a final decision. It is used only when other attempts to solve the disagreement haven't worked. Once someone asks for a hearing, the whole process must be completed within 45 days, unless both sides agree to a short extension that does not harm the student's rights.
